Kelleher International Acceptable Use Policy

This Acceptable Use Policy (the “Policy”) sets the standards of conduct for everyone who accesses or uses Kelleher International’s (“Kelleher,” “we,” “us”) services, membership program, websites, and applications (the “Services”). It applies to all participants, members, and visitors, regardless of membership tier. This Policy supplements, and is incorporated into, our Membership Terms of Service; capitalized terms not defined here have the meaning given there. Violating this Policy may result in content removal, suspension, or termination, and where appropriate, referral to law enforcement (Section 9).

1. Eligibility and Age

  • You must be at least 21 years old to use the Services. The Services are intended only for adults; persons under 21 may not access or use them.
  • You must be legally able to enter into a binding agreement and must not be barred from using the Services under applicable law.
  • We may request information to confirm age or eligibility and may decline or end access where eligibility is not met.

2. Honest Identity

  • Provide accurate, truthful information about yourself, and keep it current.
  • Do not impersonate any person or entity, or misrepresent your identity, age, marital or relationship status, background, or affiliation.
  • Do not create accounts using false information, or maintain duplicate or fraudulent accounts.

3. Prohibited Conduct

You agree not to, and not to attempt to:

  • harass, threaten, intimidate, stalk, defame, or abuse any other person;
  • engage in fraud, scams, deceptive schemes, money laundering, or any financially exploitative behavior (including “romance scams”);
  • use the Services for any unlawful purpose or to facilitate illegal activity;
  • spam, solicit, or promote unrelated commercial products, services, or schemes to other members;
  • attempt to gain unauthorized access to the Services, other accounts, or our systems, or interfere with their operation;
  • collect, scrape, or harvest information about other members by automated or unauthorized means.

4. Prohibited Content and Solicitation

You may not post, share, or transmit content that, and you may not use the Services to:

  • solicit, offer, or arrange commercial sexual services, prostitution, or escort or other adult-services activity;
  • contains sexually explicit, obscene, or pornographic material, or content that is hateful, harassing, violent, or discriminatory;
  • infringes the intellectual property, privacy, or other rights of any person;
  • is false, misleading, or intended to defraud.

5. Zero Tolerance: Exploitation, Trafficking, and Child Safety

The following are strictly prohibited and result in immediate removal, termination, and reporting to the appropriate authorities:

  • human trafficking, sex trafficking, coercion, or any form of exploitation of any person;
  • any sexual content involving a minor, or any content that sexualizes, endangers, or exploits a minor (Child Sexual Abuse Material, “CSAM”). Kelleher has zero tolerance for CSAM.

Suspected CSAM is removed immediately, preserved as required by law, and reported to the National Center for Missing & Exploited Children (NCMEC) CyberTipline and to law enforcement. Suspected trafficking or exploitation is escalated to law enforcement as warranted.

6. Respect for Others’ Privacy

  • Do not solicit, collect, publish, share, or misuse another member’s personal or contact information without their consent.
  • Treat information you learn about other members as confidential and use it only for the purpose of getting to know a potential match through the Services.
  • Do not use another member’s information for marketing, solicitation, harassment, or any unlawful purpose.

7. Reporting Violations

If you see conduct or content that violates this Policy, or you have a safety concern, report it to us at [email protected]. Please include the member or content involved and a description of the concern. We review reports promptly and prioritize safety-critical reports (such as CSAM, trafficking, or threats) for immediate action.

8. Enforcement

We may take any action we consider appropriate for a violation of this Policy, including:

  • removing or restricting content;
  • issuing a warning;
  • suspending or permanently terminating membership or access (without refund, as described in the Membership Terms of Service); and
  • preserving information and reporting to NCMEC and/or law enforcement where required or appropriate.

Our decisions on enforcement are made in our reasonable discretion. Where a removal or suspension affects a paid member, the appeal process in the Membership Terms of Service applies.

9. Changes to This Policy

We may update this Policy from time to time. We will post the updated Policy with a new effective date and, where required, provide notice of material changes. Your continued use of the Services after the effective date means you accept the updated Policy.
